I now own my old bands name (registered for life) as I was having trouble with ex-band members fleecing money & trying to use the band name...I don't know the whole law side of it but the advice I just gave is right as far as I know...[edit for addition of now]

Steve Haynie Posted October 6, 2013 Posted October 6, 2013 AFAIK band names are trademarked. You also carry the burden of having to police the name or you lose your trademark. Jay Jay French of Twisted Sister has written about having to chase down small businesses using the name of his band.
