Everyone's been afraid to take such a case to court because the resulting decision would end the debate, and neither side wants to lose. So the tactic has always been incrementalism.I think it would be difficult for a court highly educated in Constiutional law to allow a right granted by our forefathers to be legistlated out of existence without a Constitutional amendment. But we will have to wait and see...
