polara Posted August 11, 2006 Posted August 11, 2006 AuctionSeems nice. Not having looked at Monacos much unfamiliar with pricing but seems very fair.
kizanski Posted August 11, 2006 Posted August 11, 2006 Yea, I was looking at that one last night, and it IS a great price, but this last sentence has me scratching my head:"item is used and sold as is. guaranteed to be as described."HUH? "As is" usually means, "Blow me. I'm not taking it back." The word "guaranteed" by definition, means the opposite.Put both of those together, and I get a headache.
MCChris Posted August 11, 2006 Posted August 11, 2006 The word "guaranteed" by definition, means the opposite. I'm of the opinion that the word means nothing. It's an empty marketing term designed to instill false confidence in the buyer.

I agree, but you can't pick and choose what terms you will honor, and putting them together in the same ad (or sentence) cancels each other out. It's either "as is" or it's "guaranteed."Unless it's guaranteed to be "as is." Christ. There goes that headache again.
peedenmark7 Posted August 11, 2006 Posted August 11, 2006 there are few try before you buy auctions even if he were to offer it, I think buyer timed approval periods are meant to bring on the impulse buy and nothing more. I think this seller as many, is just driving the point home to bidders that if you bid, and you win, its yours.
sw686blue Posted August 11, 2006 Posted August 11, 2006 Unless it's guaranteed to be "as is." That's the way I understood it.
kizanski Posted August 11, 2006 Posted August 11, 2006 Unless it's guaranteed to be "as is." That's the way I understood it. So he means that it's guaranteed unreturnable.Ok. Got it.
BadgerDave Posted August 11, 2006 Posted August 11, 2006 My interpretation is that the seller "guarantees" that the auction description is correct, nothing else. So, if it's not mentioned in the description, the "blow me" rule applies.
cmatthes Posted August 11, 2006 Posted August 11, 2006 I think we need to get Kiz' buddy, "Esporto" to translate that one...

santellavision Posted August 11, 2006 Posted August 11, 2006 Buyer always beware on ebay.I got burned once on a stupid listing that said "Unit comes with its original box and manual" Well, the box that arrived was not the original manufacturer's box but, the outside box that that box was shipped in! Wadayagonnado.
serial Posted August 11, 2006 Posted August 11, 2006 OK, drag my ass out of bed, or away from my desk, or whatever. "See, that sign says "100% satisfaction guaranteed"? I wasnt' totally satisfied with my breakfast." "But sir, you ate just about all of it." "Look here, BRAD..." I should get my attorney to look at that, Sport. You know, the one who works on invisible retainers.

It sure can, and I am speaking from experience.Years ago, I bought a white '85/'86 Schecter PT Tele off an ebaY seller. The ad said all this stuff about the great condition it was in and pointed out that the "only blemishes are...." and listed them. Also at the end he stated that the item is sold "as is."When I got the guitar, there were four large magic marker lines on the back of the guitar (must have been a Black Flag fan), a huge sticker on the face of the guitar (neither of these appeared in his photos in the ad, even though there were photos of the front and back of the guitar), and the truss rod was snapped. To try to shorten this story up a bit, I emailed the seller and pointed out the obvious discrepancies, but declared shenanigans by pointing out the "as is" statement in his ad (AKA: The Blow Me Rule). We went back and forth, but I got nowhere.I complained to ebaY's farcical Safe Harbor group, but apparently, "as is" means that, even if you blatantly omit vital information like a broken truss rod and lie about condition, even to the point of showing inaccurate or out-dated photos, you're beat. They WILL charge you $20 to dispute the auction, though.Even though I'm addicted to it, I have to agree with The Muse: EbaY sucks.
