To get around the a statute of limitations defense, the author(s) of "Taurus" would argue that each recorded or live performance or sale is generating income and is a continuing violation of the copyrighted property rights. Led Zep would argue estoppel, that Spirit should have complained a lot earlier and can't do it now. Then bring on the lawyers at upwards of $800 per hour. to defend the claims. Plaintiff's lawyers could get 1/3 or 40% of any award if working on a contingency. Something along those lines.

A couple of months ago, after one of the New Hartford guys posted a picture if a completed unsold Newport in storage (I think it was a Newport), I contacted somebody at Willcutt, I asked if they would contact New Hartford/Fender and see if there were indeed completed Hamers in storage. He sounded excited by the prospect and told me that Wilcutt would buy anything available.. He made the call on one of the snowstorm days and the facility was closed. He said he'd get back to me but he never did. Occassionally I visit Willcutt's website to see if there are any Hamers in the "New Arrivals" section, but none have been posted. I image that some of the other former Hamer dealers could make the same call. But, now, who would they call? And where, if there are any, are they stored?

  8. So, Greg: Do they ask for an estimate? Is this a fixed price? Just curious from a business perspective. Who pays? the artist? A management company? Is this repair covered byinsurance? i am not asking for state secrets here, but anything you can share would be of interest to all of us. Thanks.

  15. The Packard factory in Detroit once employed 77,000 workers - - at one site. 77,000. My father loved those cars, but that brand is gone, too. I have owned three P90 Specials, an '80s Special, a 96? Artist Custom and I bought from Greg purportedly the last guitar (natural Standard, nickel) of the line about 2-3 Christmases ago. The cratsmanship on the Artist and the Standard (now Django49's) was incredible. I understand that Hamer was a drop in the bucket to Fender but Fender is huge and plenty of companies keep brands and models alive. How many mid-management people does Fender employ trying to find a still-cheaper off-shore source (from Japan to Korea to China to Indonesia to India and someday probably Vietnam or Myanmar) ? And how much do those 17-hour plane flights cost and the "management focus" related to that? Couldn't Fender allocate some dough to keep the brand alive, even on a custom-order basis? If nothing else just to showcase the talents of the artisans who bring these to life? Talk about deep pockets. Talk about a custom shop. The problem, as I see it, was that Fender introduced no new models to keep the line-up fresh. No Talladegas, no three soap bar P90s red Monacos, no Newports. The GuitarPlayer "Editor's Pick" awards that would have followed would have provided some visibility. Fender cranks out endless iterations of Jaguars, Jazzmasters, telies and strats. All thise Fender Special Runs. If they wanted to "revive" the various Hamer models they could have. None of this was done after the takeover. Look at it's distribution network. They could have goosed the visibility. I wonder if Fender was worried that Gibson would bring some PRS-copycat trademark litigation if Fender started to produce instruments influenced by Gibson designs. That would have definitely sucked up cash. There is more to this story than a lack of orders..
